Expert Report Checklist

Your report must comply with the relevant Court or State-based rules and the Expert Witness Code of Conduct, including the Uniform Civil Procedure Rules 2005 (NSW) or the equivalent regulations in the applicable jurisdiction. The following elements should be included in your report:

  • EXECUTIVE SUMMARY
    An Executive Summary at the beginning of your report that clearly outlines your opinion and conclusions.

  • CODE OF CONDUCT & DECLARATION
    Acknowledgment of the relevant Court's Code of Conduct (e.g., District/Supreme/Federal Court) as applicable to the jurisdiction in which the report is being submitted and a declaration that you have made all enquiries that are desirable and approporiate and that no matters of significance (that you regard as relevant to your area of expertise) have been withheld from the court.

  • GENERATIVE ARTIFICIAL INTELLIGENCE
    A statement confirming that generative artificial intelligence (AI) has not been used in generating your expert report.

    If generative AI has been used (with the court’s permission), include a statement that outlines the sections of the report where generative AI was utilised, specifying the AI program, the date of use, and the version used. In the Appendices, provide the prompts, script, or data used to generate the relevant part(s) of the report. Additionally, identify and include any applicable code of practice or principles relating to generative AI that apply to you as an expert witness.

  • SPECIALISED KNOWLEDGE
    A comprehensive statement about your qualifications and expertise, ensuring clarity on how they relate to the matter.

  • ASSUMPTIONS
    A declaration of any assumptions upon which your report is based.

  • LIST OF DOCUMENTS
    A reference to all documents you have reviewed and relied upon in forming your opinion, such as the letter of instruction, photographs, statements, medical scans, other reports, etc. You may also include documentation that you believe could have been useful but was not supplied or made available.

  • APPENDICES
    Copies or extracts of all documents, including relevant sections from Australian Standards, photographs, and other materials relied upon in forming your opinion, but not part of the client's brief. Please include a copyright notice statement in italics for these materials.
